Terms of Service

Insight Property Searches Limited (“we”, “us”, “our”) provides conveyancing search services subject to the terms and conditions set out below. No variation to these conditions shall be binding unless agreed in writing by a Director of Insight Property Searches Limited.

In providing search reports and services, Insight Property Searches Limited will comply with the Search Code.

1. Acceptance of Orders

We are under no obligation to accept any order and may refuse to provide services at our discretion without giving a reason. No contract shall exist until we confirm acceptance of your order in writing. Each accepted order constitutes a new and separate contract.

2. Accuracy of Information

We will use reasonable endeavours to ensure the information contained within our reports is accurate at the date of publication. You acknowledge that:

  • Many sources we rely on are public records and third-party data providers.
  • Information may change after the report date.
  • We cannot be held liable for omissions or inaccuracies resulting from changes occurring after publication, or from errors contained in public registers outside our control.

3. Timescales

Any estimated delivery time for a report is provided in good faith. We will use reasonable endeavours to meet estimated timescales, but these are not guaranteed. We will not be liable for delays caused by local authorities, third-party data providers, or other factors beyond our reasonable control.

4. Charges

All charges quoted are exclusive of VAT unless stated otherwise. VAT will be applied at the prevailing rate.

5. Payment Terms

A VAT invoice will be issued as soon as practicable following completion of the report. All invoices must be paid in full within 30 days of the invoice date. Failure to pay may result in:

  • Suspension or refusal of further orders
  • Reporting to relevant trade bodies and accreditation authorities
  • Recovery action and associated costs

6. Your Obligations

You agree to:

  • Provide full, accurate and up-to-date information when placing an order
  • Supply a clear and legible plan of the property to be searched
  • Ensure that any information provided to us is correct

Our reports are supplied for your use only. You may provide them to your clients, who in doing so are also bound by these Terms & Conditions. You must not alter, amend, or misrepresent any report.

7. Cancellation

If you wish to cancel or amend an order, you must notify us as early as possible.

  • Where an appointment has been booked, we will attempt cancellation without charge.
  • Any disbursement fees already incurred will be charged to you.
  • Same-day cancellations may result in the full search being carried out and invoiced.

8. Intellectual Property Rights

All intellectual property rights in our reports, data, formats, and content remain the property of Insight Property Searches Limited. You may not reproduce, distribute, or commercially exploit any report without our prior written consent.

9. Limitation of Liability

We will not be liable for:

  • Errors arising from inaccurate or incomplete information held in public registers
  • Errors arising from inaccurate plans, details, or documents supplied by you
  • Delays caused by third-party providers, Local Authorities, or circumstances beyond our control
  • Consequential or indirect losses including (but not limited to) loss of profit, loss of business, or loss of opportunity

Our total liability in respect of any claim shall not exceed £2,000,000, supported by our Professional Indemnity Insurance covering errors and omissions in local authority data and records.

10. Force Majeure

We will not be liable for any failure or delay in performing our obligations where this is due to an event beyond our reasonable control. You agree to allow reasonable time for performance once the event has passed.

11. Quality of Service

We will ensure all services are carried out with due skill, care, and diligence. All staff and contractors engaged by Insight Property Searches Limited will be properly trained, competent, and will treat you in a polite, professional manner.

12. Search Agents

We may use approved and accredited Search Agents or third-party suppliers to deliver part or all of a service. We remain responsible for ensuring that any third-party suppliers meet the required standards of quality, compliance, and professional conduct.

14. Data Protection & Confidentiality

We will process all personal data in accordance with the UK GDPR and Data Protection Act 2018.

  • Information provided will be used solely for fulfilling your order.
  • All information will be treated as confidential.
  • We will not disclose information to third parties except where required for fulfilment of the search, regulatory purposes, or required by law.

If you are dissatisfied with our service and we cannot resolve your complaint, you may refer the matter to:

16. Governing Law

These Terms & Conditions are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the English courts.
